Cafie Terms and Conditions of Use

These Terms are a binding agreement between you and ALBERTO GAUDICOS JR, an individual developer based in Philippines ("Cafie", "we", "us"), covering your use of the Cafie mobile application and website (the "Service").
By creating an account or using Cafie, you accept these Terms and our Privacy Policy. If you do not accept them, do not use Cafie.
Section 12 contains disclaimers and a limitation of liability. Section 14 contains terms Apple requires. Please read both.
1. Who may use Cafie
You must be 16 years of age or older to use Cafie. By using it you represent that you are, that you are not barred from using the Service under the laws of your country, and that you have the capacity to enter this agreement, or that a parent or guardian who does has agreed to it on your behalf.
If you are 16 or 17, a parent or guardian must read these Terms and agree to them before you use Cafie, and they enter this agreement with us alongside you.
Read Section 7 before you submit anything. On the Free plan your photograph goes to people you have not met, and any of them can save the collage and share it outside Cafie. That is worth understanding at any age and especially under 18.
Cafie is not intended for children. We terminate accounts we find to belong to anyone under 16, and we remove any account at the request of a verified parent or guardian.
2. Your account
- One person, one account. Do not create multiple accounts to circumvent plan limits, free-upload limits, or the one-photo-per-window rule. We record which accounts sign in on a device for the sole purpose of detecting this, and we may suspend accounts that do it.
- Keep your password confidential. You are responsible for activity under your account.
- Give us accurate information and keep it current.
- Tell us at support@cafie.app immediately if you suspect unauthorised use.
- You may delete your account at any time from Account Settings inside the app. Deletion is permanent and removes your profile, photos, queue entries, and circle memberships, subject to the retention rules in the Privacy Policy.
3. What Cafie does
Cafie lets you take a coffee selfie, has it checked automatically, and places it into a brew circle: a small group whose photos are composited into a single collage once everyone has submitted, or once the deadline passes.
- Circles are persistent groups; a brew is a one-time event. Each event has one deadline and produces at most one collage.
- If every member submits an approved photo before the deadline, the collage generates immediately.
- If the deadline passes first, we generate a partial collage from whoever did submit. If nobody submitted, the event simply expires.
- On the Free plan, Cafie matches you automatically with other users you have not met, in groups of up to three, from your region's pool during the same coffee window. You will not know who they are before you submit.
- Availability is not guaranteed. We may change, suspend, or discontinue any part of the Service.
4. Photos: the rules
Cafie is camera-only by design. There is no photo-library import, and attempting to bypass this is a breach of these Terms.
When you submit a photo, you confirm that:
- it is a photograph of you, taken by you, in the moment;
- it contains a real beverage, not coffee staged from an image or a screen;
- it is not a screenshot, a re-photographed screen, a stock image, an AI-generated image, or a picture of another person; and
- if any other identifiable person appears in it, you have their permission to submit it and to have it composited into a collage that other members, possibly strangers, will see and may export.
Photos are checked automatically for a face, focus, and brightness on your device, then on our servers for coffee, a real human subject, and authenticity. Photos that fail are deleted, not stored. Automated checks are imperfect; a rejection is not an accusation, and you may retake and resubmit.
5. Objectionable content and abusive behaviour: zero tolerance
Cafie shows user-submitted photos to other users. We do not tolerate objectionable content or abusive users, and we enforce this without exception.
5.1 You may not submit or transmit content that
- is sexually explicit, pornographic, or sexually suggestive;
- sexualises, endangers, or depicts a minor in any way;
- depicts nudity, graphic violence, gore, self-harm, or cruelty;
- harasses, bullies, threatens, defames, or intimidates any person;
- promotes hatred or violence against people on the basis of race, ethnicity, national origin, religion, disability, age, sex, gender identity, or sexual orientation;
- promotes illegal activity, illegal drugs, or the sale of regulated goods;
- infringes anyone's copyright, trademark, privacy, or publicity rights;
- impersonates another person, or depicts a person who has not consented;
- is spam, a scam, phishing, or commercial solicitation; or
- contains malware or attempts to compromise the Service.
5.2 You may not
- create multiple accounts to manipulate matching or circumvent limits;
- attempt to identify, contact, or track another user outside Cafie against their wishes;
- reverse engineer, decompile, scrape, or automate access to the Service;
- probe, overload, or interfere with our systems or the security of the Service; or
- redistribute another member's photograph outside the collage it appears in, or in any way that would embarrass, harass, or endanger them.
5.3 Reporting content or a user
Every collage and every circle member has a Report control in the app. Account Settings also has a Report a problem form, which is the route to use when there is no photo or member in front of you. You can also email support@cafie.app with the details.
When you report something, we commit to:
- acknowledge and act within 24 hours of the report;
- remove any content that violates Section 5.1; and
- eject the user who submitted it from the Service where the violation warrants it.
Reported content is removed from view immediately while we review it. You can also block another user from within the app; a blocked user cannot be matched with you, invite you, or see your future submissions.
5.4 Enforcement
We may remove content, withhold a collage, suspend an account, or terminate an account permanently, with or without notice, for any breach of this Section. Serious violations, in particular anything involving a minor, are reported to the relevant authorities.
6. Your content and the licence you give us
You own your photos. Nothing here transfers ownership.
To run the Service, you grant us a worldwide, non-exclusive, royalty-free, revocable licence to host, store, reproduce, resize, crop, and composite your submitted photos, and to display them to the members of the brew circle they join, for the sole purpose of operating and improving Cafie's core features for you. This licence exists only so the app can function. It ends when you delete the photo or your account, except for copies already composited into collages held by other members, and copies they have already exported.
We will not:
- use your photos in marketing, advertising, or promotional material without asking you first and obtaining your separate written consent;
- use your photos to train artificial intelligence or machine learning models, ours or anyone else's;
- sell your photos or license them to third parties; or
- make your photos public.
You are responsible for your content and for having the rights to submit it.
7. Collages are shared, and sharing is irreversible
A finished collage contains other people's faces as well as your own. Any member can save it and share it outside Cafie.
You accept that once a collage is generated, you cannot recall it. Deleting your account removes your copy but cannot delete copies other members hold or have already shared elsewhere. If that is not acceptable to you, particularly on the Free plan where members may be strangers, do not submit a photo.
When you share a collage outside Cafie, you are sharing other people's images. Do so respectfully, and do not re-share another member's face in a context that would harass, embarrass, or endanger them. Doing so is a breach of these Terms and may also break the law where you live.
8. Our intellectual property
Cafie, its name, logo, design, software, and the collage layouts and templates are owned by us and protected by intellectual property law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use one copy of the app on a device you own or control, for your personal, non-commercial use. You get no other rights.
9. Copyright complaints
If you believe content on Cafie infringes your copyright, email support@cafie.app with: your contact details; identification of the work; identification of the material and where it appears; a statement that you believe in good faith that the use is unauthorised; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them; and your signature. We remove infringing material and terminate repeat infringers.
10. Plans, subscriptions, and payment
10.1 What each plan gives you

10.2 Auto-renewable subscription terms
Cafie Premium is an auto-renewable subscription:
- Title: Cafie Premium
- Length of subscription: 1 month
- Price: US$3.99 per month, or [ANNUAL PRICE] per year, charged to your Apple ID or Google Play account at confirmation of purchase. Local prices and currency are shown in the app before you buy.
- Auto-renewal: your subscription renews automatically at the same price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- Managing and cancelling: manage or cancel in your device's Settings → your name → Subscriptions (iOS) or Play Store → Subscriptions (Android) at any time after purchase. Deleting the app does not cancel a subscription.
- Free trials: if a free trial is offered, any unused portion is forfeited when you purchase a subscription.
- Refunds: purchases are handled by Apple or Google, and refunds are governed by their policies. We cannot issue refunds for store purchases. Contact Apple Support or Google Play Support.
- Price changes: we will notify you before any price increase takes effect, and it will not apply until you have had the opportunity to cancel, as required by the store's rules.

11. Termination
You may stop using Cafie and delete your account at any time.
We may suspend or terminate your account, with notice where practical and immediately where the circumstances warrant, if you breach these Terms, if your use exposes us or other users to legal risk or harm, or if we discontinue the Service. On termination your licence ends, and your content is deleted in line with the Privacy Policy. Sections 6 (as to copies already distributed), 7, 8, 9, 12, 13, and 14 survive.
12. Disclaimers and limitation of liability
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, or error-free.
We specifically do not warrant that:
- automated photo validation will catch every inauthentic or objectionable image, or that it will never reject a legitimate one;
- a collage will always be generated, or generated on time; or
- other users will behave lawfully or decently, or will keep a collage private.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or reputation, arising out of your use of the Service. Our total aggregate liability is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US$50.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this Section may not apply to you. Nothing here limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law, and nothing here affects any non-excludable consumer rights you have in your country of residence.
13. Indemnity, governing law, and disputes
Indemnity. You agree to indemnify and hold us harmless from claims, damages, and reasonable legal costs arising from your content, your use of the Service, or your breach of these Terms, except to the extent caused by us.
Governing law. These Terms are governed by the laws of Philippines, without regard to conflict-of-law rules. The courts of Philippines have exclusive jurisdiction, except that if you are a consumer resident in the EEA or UK, you keep the protection of the mandatory consumer laws of your country and may bring proceedings in your local courts.
Informal resolution first. Before filing anything, email support@cafie.app and give us 30 days to resolve it. Most things can be sorted out this way.
14. Terms required by Apple (iOS)
This Section applies to the Cafie app obtained from the Apple App Store, and prevails over any conflicting term elsewhere in these Terms for that app.
- This agreement is between you and us, not Apple. Apple is not a party to it. We, not Apple, are solely responsible for the app and its content.
- Scope of licence. The licence granted in Section 8 is non-transferable and limited to using the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Service, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support. We are solely responsible for providing maintenance and support for the app, at support@cafie.app. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including: (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation, including in connection with the app's use of any health or fitness frameworks.
- Intellectual property claims. In the event of a third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints, and claims regarding the app should be directed to ALBERTO GAUDICOS JR, support@cafie.app.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using the app.
- Apple as third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
15. General
- Changes. We may update these Terms. We will change the "Last updated" date and, for material changes, notify you in the app or by email before they take effect. Continuing to use Cafie after that means you accept the new Terms; if you do not, delete your account.
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service.
- Severability. If a provision is unenforceable, the rest stays in force.
- No waiver. Not enforcing a right is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them to a successor.
- Force majeure. We are not liable for failures caused by events beyond our reasonable control.
